What is the Class Action Investigation Against Coles and Woolworths Over Alleged Misleading Discount Claims about?

Gerard Malouf & Partners (GMP Law) have initiated a class action investigation against Coles and Woolworths for allegedly promoting specially marked products with false discounts, claiming the price reductions were misleading or non-existent.

The investigation follows the proceedings commenced by the ACCC against Woolworths and Coles for allegedly breaching the Australian Consumer Law by misleading consumers through discount pricing claims on hundreds of common supermarket products between February 2022 and May 2023.

How are we collecting evidence to substantiate our Price Drop Class Action?

To substantiate our class action, we are gathering evidence in several key ways. The Australian Competition and Consumer Commission (ACCC) has alleged that Woolworths was involved with 266 products over a span of 20 months, and Coles with 245 products over 15 months.


Our investigation will focus on obtaining records from potential class members, including the date and time of purchases and the prices paid. Helpful evidence to support your claim includes:

  1. Rewards Program Data
    Collecting data from Woolworths and/or Coles Rewards programs, which track:

    • Time and date of purchases

    • Pricing information

    • Discounts applied.

  2. Receipts
    Gathering receipts for discounted products as proof of purchase.

  3. Statutory Declaration
    If the matter is successful and people do not have their receipts but have been affected by the pricing and suffered loss, they will be able to make a claim via statutory declaration.

Do I have a claim and am I a group member?

The class action is on behalf of everyone who bought the discounted products from Coles and Woolworths which were marked as ‘Prices Dropped’ and ‘Down Down’ in Australia, in a store or online between February 2022 and May 2023 and suffered a loss.

GMP Law will be seeking a refund for consumers of the price differential between the alleged illusory pricing and the original price.

Do I need to register to be a part of the proposed class action?

We strongly recommend you register to be kept informed of the progress of the investigation and if and when any proceedings may commence.

If you do not register your with GMP Law, we will not be able to contact you to tell you about the commencement of the proceeding and any interests that you may have in the proposed class action and the progress of the class action.

Is there any financial risk in registering?

No, there is no financial risk to you in registering with our law firm.

What will it cost me?

We propose to bring the class action on a 'No Win-No Fee' basis. This means we will not charge any professional legal fees or out-of-pocket expenses until the matter is successful.

We also at this time do not intend to ask you to sign a litigation funding agreement or a conditional costs agreement as we intend to seek a Solicitor’s Common Fund Order as a percentage payment approved by the court if this matter is successful.

We presently intend to commence proceedings in the Federal Court of Australia.

How much compensation can I get?

At this stage, we are not able to determine how much compensation each group member may receive from the proceedings.

I don’t have any receipts from Coles and Woolworths, can I still register?

We encourage you to register your interests in the class action even if you aren’t sure. As the investigation progresses, we will be more readily able to identify your eligibility in the proposed class action.
